The present taxation law case deals with the Individual named James Cookie (‘James’) who is a ships officer and employed by the corporation Sails International Inc. (‘Sails’). The company operates the cruise and passenger boats in the Pacific Ocean. James has a house in Sydney but his estranged wife and children stay in Singapore. James has let out his home along with the furniture which is also owned by him. Whenever he visits Sydney, he stays in the house in a separate room belonging to him with his own personal belongings. In the current years James has spent 80 days in his house and the remainder of the time spent in the cruise ship except for 20 days spent visiting his family in Singapore.

Given the above facts and for taxation purposes, whether James is a resident of Australia or not is the question. We will see the relevant tests and statutes which explains the notion of residency in Australia and the implication of the same in the case of James.
